¿Fuiste víctima de fraude en un caso de ciudadanía? USCIS te dice qué hacer
En un fraude en un caso de ciudadanía, solamente los abogados o representantes autorizados que trabajen para una organización reconocida por la Junta de Apelaciones de Inmigración pueden dar consejo legal.

Para prevenir que seas víctima de fraude en un caso de ciudadanía, el Servicio de Ciudadanía e Inmigración (USCIS) presentó una guía con consejos para que no seas víctima.

Si ya eres una víctima, también te dice qué pasos puedes seguir en caso de haber sido engañado.

Las estafas más comunes de fraude en un caso de ciudadanía son:

  • Estafas en la Reinscripción a TPS

No pagues ni presentes ningún formulario hasta que USCIS actualice la información oficial sobre reinscripción para tu país

  • Formulario I-9 y estafas por correo electrónico

Empleadores han recibido correos electrónicos que aparentan provenir de USCIS, solicitando datos del Formulario I-9 (Verificación de Elegibilidad de Empleo).

Recuerda que los oficiales de USCIS nunca te solicitarán que descargues, completes, subas a los archivos o inspeccione el Formulario I-9 por correo electrónico, así como tampoco se presentará el Formulario I-9 a USCIS, bajo ninguna circunstancia.

Los empleadores deben tener un Formulario I-9, Verificación de Elegibilidad de Empleo, por cada persona en su nómina a quien se le requiera completar el mismo. Todos estos formularios deben ser retenidos por un período de tiempo.

  • Notarios Públicos

En muchos países latinoamericanos, el término “notario público” se refiere a algo muy diferente a lo que significa en los Estados Unidos. En diversas naciones de habla hispana, los “notarios” son abogados con credenciales legales especiales.

Los notarios públicos en EU son personas designadas por los gobiernos estatales para presenciar la firma de documentos importantes y administrar los juramentos.

Ser un “notario público” no autoriza a una persona a proporcionarle ningún servicio legal relacionado con inmigración.

  • Pagos por Teléfono o Correo Electrónico

USCIS nunca te pedirá que transfieras dinero a una persona. No acepta Western Union, MoneyGram, Paypal, o tarjetas de regalo como pago para tarifas de inmigración.

Además, nunca te pedirán que pagues tarifas a una persona por teléfono o correo electrónico.

  • Ganar la Lotería de Visas

USCIS no administra el Programa de Visas de Diversidad para Inmigrantes (DV, por sus siglas en inglés). Este programa lo administra el Departamento de Estado. El Programa DV también se conoce como la lotería de visas.

  • Sitios web fraudulentos

Algunos sitios web dicen estar afiliados a USCIS y ofrecen instrucciones paso por paso sobre cómo completar una solicitud, requerimiento  o petición de inmigración.

Asegúrate de que la información proviene de USCIS.gov u otra fuente legítima afiliada con USCIS.

  • Ofertas de empleo

Ten cuidado con las ofertas de empleo ofrecidas por empresas en el extranjero o por correo.

OJO Si recibes una oferta de empleo por correo electrónico antes de salir de tu país y venir a los Estados Unidos, pudiera ser una estafa particularmente si le piden dinero a cambio de una oferta de empleo.

  • Estafas a estudiantes

En el caso de los estudiantes, USCIS les recomienda asegurarse de que solicitan ingresar a institución académica o universidad acreditada.

¿Cómo reporto el fraude en un caso de ciudadanía?

En caso que hayas sido víctima de una estafa de servicios de inmigración y necesites ayuda, USCIS te recuerda que puedes reportar los fraudes de inmigración o de impuestos a la Comisión Federal de Comercio.

Otra opción es presentar una denuncia en el estado en el que radicas.

Recuerda que reportar estafas no afectará su solicitud o petición de inmigración. Además, muchos estados permiten reportar fraudes anónimamente.
